Terms of the agreement:
Payment Terms / Cancellation Policy: 1/2 of rental due upon reserving property and balance due 6 weeks prior to arrival or in full if booking is made within one month of arrival date. No refunds after 45 days prior to arrival unless unit is re-rented, in which case renter shall receive a refund minus a 25% handling fee for actual days re-rented.
Rental Usage: Tenants expressly acknowledge and agree that this agreement is for transient occupancy of the property, and that tenants do not intend to make the property a residence or household. Owner/Property Manager has the right to move guest if necessary to comparable unit.
House Rules: Quiet hours 9pm-9am. The guests shall conduct themselves in a civilized manner, respecting the rights of the surrounding Guests and property owners. The Guests shall not create unreasonable noise or disturbances. Turn off or dim outdoor lights & be quiet after 9pm. Drive slowly.
Smoking Policy: All Casitas / Houses are non-smoking. If smoking is evident, Tenant will incur a $500 fine. Guests may smoke on patios and outside unit. All cigarette butts must be cleaned up in and around property or may incur additional cleaning fee.
Internet Access: Our properties have various types of Internet access provided by various third parties. Neither Manager nor Owner is responsible for data loss, theft, loss of Internet access or connection, or inability of the Guest to connect to the Internet.
Hot Tub: Shower before & after. No children under 16 without adult supervision. Hot tub hours are 8am-9pm. Our hot tubs are maintained and chemical levels checked per the manufacturers specifications on a regular basis. When using the hot tub, remember there is a certain health risk associated with this facility. USE AT YOUR OWN RISK. Tubs may automatically go into the economy mode so you may need to allow time for heating. Do not stand on hot tub covers - they are for insulation purposes only & not designed to support weight of a person(s). Please put cover back on tub when finished using tub. Damage to cover may result in charge to your credit card for replacement. Use caution on wet floors, near hot tub, steps & icy areas.
Water Conservation: New Mexico is a drought state. Please Save Water. Many properties are in historic districts and thus plumbing can become clogged if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products, Kleenex or paper towels should be flushed at any time. If it is found that any of these items have clogged the septic system, guests will be charged for any damages or plumbing fees up to $500.00.
Pet Policy: Dogs allowed in "Pet Friendly" units at $15/night. Dogs must be kept on leash in common areas and are not to be left unattended on patio areas. Pets must have flea & tick medicine prior to arrival. No pets on bedding or furniture (please bring "pet blankets" or "dog bedding"). Pet owners are responsible for picking up after their pet. A $25 fee will be charged for any pet waste left in and around the property or patios.
Property Condition / Cleaning: Guest is expected to maintain the property in a reasonable condition during their stay. There are no housekeeping services during short vacation stays. Long-term Guests may utilize interim cleaning at their own expense and is available upon request. Guests assume liability for any loss or breakage of the contents of the property. We are not responsible for "Act of God or City/State." No refunds for weather, electrical or water. If there is a breakage or damage to the appliances, furnishings, or the property itself, the Guest is responsible for reporting such findings to the Manager as soon as possible. The Guest understands that the Manager reserves the right to charge an additional cleaning fee or charge for damages up to $500 on Guest's credit card if the condition of the property, upon the expiration of the term of occupancy, so requires.
Trash Removal: Please re-cycle. There are bins outside the units or you may separate and leave for housekeeping. Place trash in plastic bags and put in trash containers. No loose trash in trash containers.
Injury and /or Loss: The Guests shall herby indemnify and hold harmless the Owner, Manager and their contractors or employees against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Owners insurance does not cover loss or damage to Guest's personal property and Guest(s) shall purchase their own insurance if such coverage is desired.
Disputes: The law of the State of New Mexico shall govern all controversies and disputes between the parties. All controversies or disputes shall reside in Santa Fe County, and/or Taos County New Mexico regardless of where the rental agreement was signed. Guests shall be responsible for any attorney's fees and other expenses incurred by the Manager or Owner should Guest breach this agreement.
Repairs and Maintenance: Guest understands that the Manager may enter
the unit to affect necessary repairs. Manager reserves the right to
move the Guest if needed repairs cannot be accomplished in a timely
manner.
